1. Acceptance of Terms

Welcome to DeepWave Leads. These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("Client", "User", "You") and DeepWave Leads ("Company", "We", "Us").

By accessing our website or purchasing our lead generation services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use our services.

2. Description of Services

DeepWave Leads provides digital marketing and lead generation services specifically for the pool construction industry. Our services include, but are not limited to:

  • Acquiring potential customer information ("Leads") via digital advertising.
  • Verifying contact information and intent where possible.
  • Delivering lead data to Partners via email, SMS, or CRM integration.

Territory Exclusivity: Unless otherwise stated in a specific agreement, leads sent to you are exclusive and will not be sold to other contractors in your designated territory.

3. Payments & Refunds

All services are billed as per the agreed pricing structure (e.g., Pay Per Lead or Monthly Retainer).

  • Non-Refundable: Due to the nature of digital data, all sales are final. We do not offer cash refunds once a lead has been delivered.
  • Cancellation: Monthly subscriptions may be cancelled with 30 days written notice.

4. Lead Quality & Replacement Policy

We strive for high-quality, high-intent leads. However, we offer a Lead Replacement Credit for invalid leads. You must report an invalid lead within 48 hours.

Qualifies for Credit

  • Disconnected phone number.
  • Lead is outside your service territory.
  • Lead is looking for services you do not offer (e.g., repairs vs installs).

Does Not Qualify

  • Lead did not answer the phone.
  • Lead decided not to buy due to price.
  • Lead already hired another contractor.

5. Messaging & SMS Consent

By filling out our contact forms or partner applications, you expressly consent to receive communications from DeepWave Leads, including text messages (SMS), calls, and emails.

  • Purpose: Communications regarding your application status, new lead alerts, and account updates.
  • Opt-Out: You may reply STOP to any message to unsubscribe instantly. Reply HELP for assistance.
  • Fees: Standard message and data rates may apply. Message frequency varies based on lead volume.
  • Carrier Liability: Carriers are not liable for delayed or undelivered messages.
  • Privacy: Your phone number will not be shared with third parties for marketing purposes.

6. Limitation of Liability & Age Restriction

Age Restriction: You must be at least 18 years of age to use this Website and our Services. By using this Website and by agreeing to these Terms and Conditions, you warrant and represent that you are at least 18 years of age.

DeepWave Leads acts solely as a marketing and lead generation agency. We are not responsible for:

  • The outcome of any specific lead or project.
  • Contracts, disputes, or liabilities arising between you (the Contractor) and the homeowner.
  • Any indirect, incidental, or consequential damages resulting from the use of our services.
